Employee Breaks Overview

Meal periods and rest breaks for most non-exempt employees are required  to be provided by all California employers. If you work longer than five hours on your shifts, but have been deprived of lunch breaks or rest periods, you might be entitled to compensation in the form of unpaid wages, especially if there is a  practice of prohibiting or discouraging such breaks.

California Law Concerning Employee Breaks

  •  Most non-exempt employees are entitled to an uninterrupted, 30-minute, uninterrupted meal period for every five-hour work shift.  Employees that work more than ten hours are entitled to a second 30-mintue, uninterrupted meal period.
  •  Most non-exempt employees are entitled to one 10-minute rest period during every four-hours of work.

Employers who fail to provide meal periods or rest breaks may be liable to each employee for one extra hour of pay per day of violation.  California law also allows employees victimized by labor code violations to assess penalties against their employer for as much as $200 per employee, per violation, per pay period pursuant to California’s Labor Code Private Attorney General Act of 2004 ("PAGA").
