Durational Alimony Overview

Durational Alimony

Laws governing alimony changed dramatically on July 1st, 2010. Since the new statute became effective, many formerly ineligible parties are now candidates for alimony, particularly those who divorced from short- to mid-term marriages (less than seven years and eight to 16 years, respectively).

If you have been a stay-at-home wife or husband and have sacrificed your career to raise children and your marriage is one of moderate duration you are likely a candidate for durational alimony. If you stayed home to take care of a special needs child – even in a short-term marriage – you may qualify for alimony.

We take many factors into account when discussing alimony amounts including the income difference between parties. If unemployed, a vocational evaluation can identify your skills. Results dictate if you are currently qualified to return to the work force – and, if not, how long it will take to qualify. We then look at job opportunities for your skill set and recommend a realistic and fair alimony amount.

If you worked in a family business while married, additional skills may be required to enter the workforce. In this situation, alimony can help ease the financial burdens of vocational or academic coursework. We will work toward the best possible solution given your unique situation.
