DUI Chemical Tests
Although blood and breath tests are commonly used to convict people who have been arrested for drunk driving, these chemical DUI tests are not always accurate.
Breath Tests
Before a breath test can be administered, the officer must observe the person receiving the test for at least fifteen minutes. During that time, the person receiving the breath test should not have any foreign objects in their mouth. Foreign objects – such as tongue rings – can negatively influence the outcome of the test.
Breath tests can also produce false readings because of a person’s diet. For example, people who are on the Atkins diet often have high levels of ketone in their body from eating an excess of protein and a lack of carbohydrates. Some breath tests incorrectly read ketones as alcohol. As a result, a sober person on the Atkins diet could blow three or four times the legal limit.
Blood Tests
Blood tests used to measure a person’s blood alcohol content (BAC) have a fair amount of room for error as well. Blood must be drawn within two hours of the arrest and needs to be drawn by an authorized medical professional. If a blood test is close to the legal limit, it is possible to have a second vile of blood tested independently. An experienced lawyer can help ensure this follows the proper procedures.
