Relocation can further complicate divorce. At Kallen Law Firm, LLC, we help clients from the St. Louis, Missouri, area clarify divorce relocation issues. Our attorneys, Craig G. Kallen and Patrick W. Pedano, are results-driven advocates of parental rights and child welfare.

Our focus is family law. We are selective with our cases to give special attention to our clients. We strive toward efficiency, affordability and environmental consciousness in everything we do. We have 22 years of experience in these matters and have a track record of helping our clients achieve the best possible results. We take the welfare of children and parental rights very seriously.

Why Do I Need an Attorney?

First, permission from the court is required to relocate out of state following a divorce. Regardless of the reason – even career moves or remarriage – the court makes the determination.

Job transfer is the most common reason for relocation, followed by career change, remarriage, and moving to help sick or aging family. The unfortunate reality is that relocation divorce cases are the most heavily contested. There is no settling out of court. The court either lets you relocate or not. Thus, to achieve the best possible outcome, you need an attorney with relocation court experience to navigate these highly technical procedures. Our lawyers will walk you through the process while easing any anxieties you might have.

Addressing Your Concerns

Our relocation clients share similar concerns. What happens if I lose the case? If I relocate, will I lose frequent and meaningful contact with my children? How will we schedule visitation? How will I afford the significant cost of travel? If relocation isn't allowed, how can I live without my new spouse or job?

We can help you address these concerns. We listen, empathize and can help you prepare for the future.

Steps Taken

In a relocation case, it is mandated that certain things take place. In Missouri, you are required to write and send a certified letter to your ex-spouse 60 days prior to relocation stating where and when you are moving and how it is going to affect visitation.

The receiving spouse must respond within 14 days. If there is an objection, then the issues go to the court for resolution. If the non-moving spouse does not object, then the move can take place.

Typically, however, relocation is contested by the former spouse. We then proceed with resolving the case through trial, and the judge makes a final decision.
