Santiago J. Padilla's primary practice areas are as follows:

Immigration and Nationality Law.

The Immigration and Nationality Law matters that Mr. Padilla handles includes advising clients with respect to obtaining Employment-Based Visas, Investor Visas, Work Permits, Permanent Residency ("Green Cards"), U.S. Citizenship and Waivers of Grounds of Inadmissibility. We prepare petitions and applications for L-1A Visas (transferred employees), E-1 and E-2 Visas (treaty traders and treaty investors), H-1B Visas (professional employees), O-1 Visas (artists and persons with extraordinary ability), J-1 Visas (trainees), and R-1 Visas (religious workers) among others. We also prepare petitions for U.S. Permanent Residency, such as EB-1 Visas (transferred employees and persons with extraordinary ability), EB-2 Visas (professional employees with advanced degrees), EB-3 Visas (employees with special abilities), and EB-5 Visas (employment creation investors), including EB-5 Regional Centers. Part of our practice also involves seeking Waivers of the Grounds of Inadmissibility and Unlawful Presence.

Real Estate Transactions

The Real Estate practice includes the Acquisition of Commercial and Residential Real Estate, Development of Real Estate Projects, including Condominium Development, Commercial Leases, and Title and Lien Searches, including providing Title Insurance Policies through Old Republic National Title Insurance Company, one of the largest title insurance underwriters in the United States. We advise clients in the preparation and execution of letters of intent, purchase agreements, financing documents, escrow agreements and related documentation. Over the last 10 years, Mr. Padilla has acted as Escrow and Closing Agent for over 200 real estate transactions, ranging in value from $50,000 to over $15,000,000.

Commercial Transactions and Acquisitions

The Commercial Transactions that Mr. Padilla handles include Joint Ventures, Acquisition and Sale of U.S. Businesses, Investments in U.S. Projects, and other Commercial Matters. We advise clients regarding organizing of U.S. companies, structuring the business, shareholder agreements, and other matters regarding operations of U.S. businesses, such as Distribution Contracts, Service Agreements, Representative Agreements and other matters. Many of our clients in this area are foreign nationals that are coming to the U.S. to establish a subsidiary of their foreign company, acquire a new business such as a franchise or other established company, or to simply organize a new business and, in many cases for purposes of immigration.

Labor and Employment Law

Our Labor and Employment Law practice includes, among other matters, advising employers and employees in relation to Employment Contracts, Separation Agreements, Non-Compete Agreements, Employment Disputes and Employment Lawsuits, including Wage and Hour Claims, Employment Discrimination Claims and Harassment and Hostile Work Environment Claims. We also assist client in performing self-audits of their employment practices, as well as the preparation of Employment and Personnel Manuals and Policies. In addition, we have advised companies with respect to U.S. Department of Labor, U.S. Citizenship and Immigration Service (USCIS) and Immigration and Customs Enforcement (ICE), audits and investigations, as well as actions by or before other governmental agencies, like the U.S. Equal Employment Opportunity Commission and the Florida Department of Economic Opportunity.

Commercial Litigation

The Commercial Litigation matters that Mr. Padilla handles include causes of action for breach of contract, non-compete agreements, disputes among partners and shareholders and the collection of bad debts and insufficient fund checks. A unique aspect of the Firm is that we are experienced in both commercial transactions as well as commercial litigation, in that the attorneys of the Firm have litigated over 120 cases involving a wide variety of disputes in the State and Federal Courts during the last 10 years.
