Our Firm and Our Philosophy

Our firm is dedicated exclusively to criminal defense. Our strong record of successful criminal defense litigation is based upon practical experience and accomplishment. Our firm intentionally remains small in order to maintain in-depth attention to our cases, quick response, and prompt follow through. The facts and issues of each case receive the necessary individual attention of Mr. Draskovich.

What distinguishes our criminal defense firm from other firms?

A criminal lawyer is a trial lawyer. The law firm of Robert M. Draskovich, Chtd. practices criminal law exclusively. We are in court every day defending people charged with serious crimes. We do not draft contracts, file bankruptcies, handle divorces or pursue personal injury claims. The complex and ever changing field of criminal law requires daily devotion and attention. We conduct our own investigation of your case.

The police are dedicated to putting you in jail. They often claim to be objective fact finders. However, people who seek careers in law enforcement are often overzealous crusaders who feel they can make the world a better place, one arrested person at a time. Unfortunately, law enforcement officers often make up their minds once an accusation is made, and then look only for evidence that supports their conclusion that you are guilty. Meanwhile, evidence that helps you or mitigates your guilt is discarded, ignored, or buried.

Our firm has an in-house private investigator to assist in the defense, investigation and protection of our clients' rights. A person accused of a crime should not have to depend only upon the investigation of the police, but should have his own independent investigation of the allegations made against him. A criminal investigation by the state or federal government is like no other experience you have had. The focus of the investigation is not some "search for truth" or a pursuit for a settlement amount, an apology, or a piece of missing information. The ultimate goal of the government's investigation is to take away your freedom.

The initial reaction of an individual accused of a crime is to try to explain. This is the reaction seen in many civil lawyers, who are accustomed to this response in civil matters and civil lawsuits. However, the civil arena is fundamentally different from the criminal arena. Often times, the state or federal government is on a crusade. This Inquisition-like mind set is different from that generally found in a civil action. Consequently, presenting evidence to the government in the hopes of avoiding a prosecution often backfires. You show what you have, and the government does not. Meanwhile, law enforcement seeks additional evidence to rebut your story, and help its own version of events. In some circumstances, law enforcement officers will even lie to you in order to get you to admit to something that they need to make their case against you stronger.
