In modern, complex transactions and complex litigation, winning does not always mean defeating every adversary, taking advantage of every opportunity, or grabbing everything and leaving nothing for opposing parties. In complex transactions, especially those involving continuing business relations, developing trust may be more valuable and worth sacrificing an advantage. In complex litigation, co-defendants may gain more by sacrificing some of their cross-claims against each other, in order to avoid making the plaintiffs’ case by such attacks on each other. In continuing complex litigation, like asbestos litigation, it is not enough to win, if winning costs so much effort and expense that the repeated cost of successful defenses of multiple law suits produces an unsustainable cumulative cost.
A competitive advantage to our clients from using our firm, is that the integration of our business and transaction practice and our litigation practice, means that our attorneys never lose sight of the fact that legal fees are business expenses, and like all business expenses, they must be able to stand up to cost-benefit scrutiny. We will not propound discovery or make motions just because we can. We will not spend our clients’ money just because that is the customary or “standard procedure.” And we will not recommend a strategy or tactic because it allows us to maximize the lawyers’ billable hours and revenues.
Like professional sports and even some college Division I sport programs, some law firms have grown so big that their corporate mentality and the economic necessity of corporate growth and profit can cloud the traditional professionalism. To a true professional, whether a physician or a lawyer, loyalty and fidelity to the patient or client requires even the sacrifice of the professional’s own interests to those of the client. Winning means doing what is right and best for our client, always, no matter the consequences.
Being small makes us nimble. We are not bogged down in meetings, administration, or “standard procedures.” We can innovate. We can imagine and turn imagination into new strategies, plans and tactics.
