Child Support Modifications Overview

In 2010, New York state made important revisions to child support standards. New provisions of the law raised the statutory cap from $80,000 of combined parental income to $130,000. While this is a welcome raise to the child support threshold guidelines, you still need representation from a skilled negotiator and family law attorney who will consider factors that fall outside the guidelines, such as:

New Language for Child Support Modifications

Given all new judgments and orders each party has a right to seek a modification under any one of the following conditions:

  •  Substantial change of circumstances
  •  Three years have passed since the order or the last modification order was established
  •  A change in either party's income of 15 percent or more since the order or the last modification order

The parties can opt out of the three-year period and the 15 percent clauses. These conditions only apply to orders going forward. They are not retroactive.
