Child Support Modifications Overview
In 2010, New York state made important revisions to child support standards. New provisions of the law raised the statutory cap from $80,000 of combined parental income to $130,000. While this is a welcome raise to the child support threshold guidelines, you still need representation from a skilled negotiator and family law attorney who will consider factors that fall outside the guidelines, such as:
- Day care
- College funds
- Special educational or medical needs
- Life, work or location hardships
- Career changes
- Relocation
- Income level changes
In more than two decades of experience, I have represented clients ranging from military men and women to professional athletes to high net worth executives. Every client and every child requires creative resolutions for their unique situations.
Child Support Modifications and Enforcement
As years pass, even the most water-tight child support order may need modifications that require ex-spouses to re-enter family court to adjust to changes in circumstances. At the law office of Keith B. Schulefand, Esq., we have advocated for both custodial and non-custodial clients. We work to ensure that our clients get what they deserve and that their ex-spouse is held legally accountable.
New Language for Child Support Modifications
Given all new judgments and orders each party has a right to seek a modification under any one of the following conditions:
- Substantial change of circumstances
- Three years have passed since the order or the last modification order was established
- A change in either party's income of 15 percent or more since the order or the last modification order
The parties can opt out of the three-year period and the 15 percent clauses. These conditions only apply to orders going forward. They are not retroactive.
