While the department is able to enforce those child support obligations that are ordered by the Court, child support agreements made outside of the court system are virtually impossible to monitor and enforce. If you are required to pay child support in compliance with a court order, you will not receive credit for payments made outside the Probation Department unless the recipient of those payments advises Probation that the funds have been received.
Overnight visits with the non-custodial parent reduce that parent’s child support obligation. However, if the non-custodial parent fails to pay child support, he/she still has a right to see his/her child(ren). As long as you and the other parent share legal custody, both of you have the right to see your child(ren).
