Chapter 7

An individual must qualify for Chapter 7, meaning that certain requirements must be met. The requirements are mainly based on your income and what assets you have. It’s important to know that if you do not qualify for Chapter 7, you may be able to qualify for Chapter 13.

If you qualify to file for Chapter 7, you will be able to discharge all unsecured debt. This includes credit card bills, medical bills and other personal loans. As soon as you file Chapter 7, a court order is put in place to stop creditor harassment, stop foreclosure, stop repossessions and stop wage garnishments. Many times, you will be able to keep your home, car and other belongings.

Chapter 13

The basis for Chapter 13 is repayment of certain debts through a payment plan that is determined by the bankruptcy court. To qualify for Chapter 13, an individual must have a regular incoming paycheck that demonstrates he or she has the ability to make the determined monthly payment amount.
 
Some debt may be discharged in Chapter 13 at the end of your plan, and you will likely be able to keep your home, car and any other belongings. Speak with a bankruptcy lawyer to determine what debt will be discharged at the end of your plan.
