The bankruptcy reforms that took effect in October of 2005 succeeded in creating more confusion about this area of the law among consumers. With that in mind, here are a few facts to know about Chapter 7 bankruptcy:

  • Most consumers who would have qualified under the pre-October 2005 laws would still qualify today.
  • A Chapter 7 bankruptcy can eliminate most types of unsecured debts, including most credit card debts, but there are certain exceptions.
  • You can keep your home and car, provided you follow certain steps, and you are current on payments or can make up any late or missing payments.
  • You can file for Chapter 7 bankruptcy protection if you have not received a Chapter 7 discharge in the last eight years or a Chapter 13 discharge in the last six.
  • You do not have to be U.S. citizen to file bankruptcy if you have a Social Security card, a taxpayer ID, or you own property in the United States.
