The penalties for a fourth DUI conviction in California vary depending on the dates of previous alcohol-related driving convictions.

In essence, there is a 10-year look-back period for DUI convictions. This means that if one or more of your previous DUI or "wet reckless" convictions occurred more than 10 years ago, the new case will most likely be charged as a misdemeanor-level first, second or third offense, as appropriate, unless you have a prior felony DUI conviction or the new case involves an injury or death to another person.
